These Terms of Use govern access to and use of the Active Recovery Solutions website, educational content, digital products, and general online resources. By using the website or purchasing a digital product, you agree to these Terms.
1. Educational Information; No Emergency Care
Website pages, social media content, emails, downloadable resources, and general educational materials are provided for informational and educational purposes. They are not emergency services and are not a substitute for individualized medical diagnosis, treatment, or care from an appropriate licensed professional.
Do not use this website, email, social media, or an online booking request for a medical emergency. Call 911 or seek immediate in-person medical attention when emergency symptoms are present.
2. When a Professional Relationship Is Established
Viewing the website, sending a general inquiry, following Active Recovery Solutions on social media, or purchasing a self-guided digital program does not by itself establish a physical therapist-patient relationship. A professional relationship may be established only after Active Recovery Solutions accepts you as a client, required intake and consent documents are completed, and an appropriate service is provided.
3. Online Services and Client Location
Online movement assessments and other virtual clinical services are subject to professional licensing, scope-of-practice, telehealth, and safety requirements. You must accurately state your identity and physical location at the beginning of each virtual appointment. Active Recovery Solutions may decline, stop, cancel, or refer a service if it is not legally or clinically appropriate to provide it where you are located.
If Active Recovery Solutions cancels before the appointment because the service cannot legally or safely be provided, you will be offered a reschedule, appropriate referral guidance, or a refund of the appointment fee.
4. Exercise and Participation Risks
Exercise and movement testing involve inherent risks, including temporary soreness, symptom aggravation, falls, strains, and other injuries. You are responsible for providing accurate information, following instructions, using an appropriate environment, and stopping any activity that feels unsafe.
5. No Promise of Results
Individual responses to rehabilitation, exercise, and training vary. Active Recovery Solutions does not promise or guarantee that pain will resolve, that a specific diagnosis will be identified, that you will return to a particular activity by a particular date, or that any program will produce a specific result.
6. Digital Programs
Self-guided programs are general educational exercise resources and are not individually customized unless expressly stated in writing. You are responsible for deciding whether you can safely participate and for obtaining medical clearance when appropriate.
7. Intellectual Property
Unless otherwise stated, all website copy, exercise descriptions, videos, graphics, worksheets, templates, programs, downloads, and other materials are owned by or licensed to Active Recovery Solutions. Purchases grant one individual a limited, personal, nonexclusive, nontransferable license to use the material for personal use.
You may not copy, reproduce, share login access, distribute, publish, resell, teach from, modify for resale, or create derivative commercial products from Active Recovery Solutions materials without prior written permission.
8. Acceptable Use
Do not use the website or services for unlawful, fraudulent, abusive, or harmful purposes.
Do not attempt to gain unauthorized access to accounts, systems, records, or restricted materials.
Do not upload malicious code or interfere with website operation.
Do not impersonate another person or provide false scheduling, payment, identity, age, or location information.
9. Payments, Cancellations, and Refunds
Prices and payment terms are displayed at purchase or booking. The Cancellation & Refund Policy is incorporated into these Terms. Additional terms may apply to individualized coaching, physical therapy, packages, or other services and will be provided in a separate agreement.
10. Minors
A parent or legal guardian must purchase, authorize, and supervise services for a client under 18. A parent or legal guardian must attend the entire online movement assessment, complete required consents, and remain available to assist with safety and technology.
11. Third-Party Platforms
Scheduling, payment, patient portal, telehealth, email, and other services may be provided through third-party platforms. Your use of those platforms may also be governed by their terms and privacy policies. Active Recovery Solutions is not responsible for outages, data practices, or services outside our reasonable control.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the website and general educational materials are provided “as is” and “as available,” without warranties of uninterrupted access, error-free operation, fitness for a particular purpose, or a particular health or performance outcome.
13. Limitation of Liability
To the fullest extent permitted by law, Active Recovery Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or general educational materials. Nothing in these Terms is intended to waive duties or liability that cannot legally be waived, including professional duties arising after a physical therapist-patient relationship is established.
14. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute not subject to a separate written agreement will be brought in a court of competent jurisdiction in Medina County, Ohio, to the extent permitted by law.
15. Changes and Severability
We may update these Terms by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions will continue in effect.
